Abstract
Crime and criminality have been associated with humans since ancient times. While the progress of civilization has led to the development of technology and information, it has also resulted in new forms of crime, including cybercrime. Cybercrime encompasses criminal activities such as theft, fraud, forgery, defamation, and mischief, as well as new age crimes such as hacking, web defacement, cyber stalking, and web jacking. The abuse of computers and the internet has made it difficult to describe and even hide criminal activities.
newlineThe term cyber refers to the science of cybernetics, derived from the Greek verb kubernao, meaning to steer, and governing the idea of navigating through a space of electronic data. Today, computers are used in every sector of society, including communication, railways, banking, air travel, education, medical, agriculture, industry, judiciary, advocacy, and engineering. Information technology has become a valuable source for the development of commerce, communication, entertainment, and companionship, affecting human life in every respect around the world.
newlineThe legal definition of crime is any act or omission forbidden by law. In the modern world, people commit crimes with the help of available technology. Due to the lack of regulation in this area, traditional law was applied, but this was not enough to control all types of cybercrime. The nature of cybercrime is transboundary, related to virtual space, hence existing laws were not sufficient to curb it.
newlineThe last decade has been significant in human history, as the internet and the worldwide web have flourished. Internet has set up new standards for mankind. However, the unplanned nature of the internet is a system of anarchy, and no useful purpose would be solved in trying to regulate it. However, as time passed, it began to dawn upon netizens that internet and cyberspace need to be regulated, and a regulated cyberspace would be the catalyst for the future progress of mankind. Herein lay the seeds of origin of cyber law.
