dc.description.abstractMalicious prosecution is a legal claim that allows a person to seek redress for wrongful newlinelegal actions taken against them without proper cause. The concept of malicious newlineprosecution serves to protect individuals from the misuse of the legal system for newlinepersonal gain or vengeance ensuring that people are not unjustly dragged into lengthy newlineand costly legal disputes due to malicious intent. It differs from other torts like newlinedefamation or abuse of process, as it specifically involves the initiation of legal action newlinewithout valid basis. This can lead to serious consequences for the plaintiff, including newlinereputational damage, emotional distress and financial burdens. Malicious prosecution newlineclaims can be challenging to prove because of the high burden of evidence, as the newlineplaintiff needs to show that the defendant acted with malicious intent and that the newlineoutcome of the legal process was favourable to them. However, if successfully proven newlinevictims of malicious prosecution can recover damages for the harm suffered which can newlineinclude compensation for lost wages, emotional distress and attorney s fees incurred newlineduring the wrongful legal proceedings. An exhaustive comparative analysis between newlinethe Indian and the American legal framework regarding malicious prosecution has been newlinedone which synthesizes the similarities and differences in the laws, their application newlineand the challenges faced by the victims in both countries. It offers practical newlinerecommendations for reforming the legal system to better protect individuals from newlinemalicious prosecution. These suggestions include potential legislative reforms, newlineimprovement in judicial oversight, better safeguard against abuse of power by newlineinvestigating agencies and enhancement in compensation framework. newline
