Quest for Speedy Trials in India

Abstract

quotIt is a well-settled principle that quotquotJustice delayed is justice denied,quotquot and Speedy Justice is newlineour fundamental right . Getting a Speedy trial is a fundamental right of citizens of India newlineunder Article 21 of the Constitution of India. The right to a timely or speedy trial was newlinedeemed to be an integral component of the fundamental right to life and liberty, as stated newlineby the Hon ble Supreme Court of India in Katar Singh v. State of Punjab. newline16 newline. But if we newlineanalyse the data of the National Judicial Data Grid17 newline, Report of Law Commission of India newline245 Report18and NITI AAYOG19 Reports in Chapter: - 37, Legal Judicial and Police Reforms, newlineNITI AAYOG (Govt. of India), Strategy for New India at 78, (November 2018) report20 newline newlineIt was stated that To safeguard people s safety and security, as well as access to competent newlineand efficient legal systems speedy justice delivery system is a must. According to the newlinereport, it will take approximately 20 years on average to settle a property dispute, and it newlinewould take 324 years to clear the existing backlog at the current pace of disposal. The newlinemassive backlog of outstanding cases is a key logistical and efficiency concern. 21 We will newlineget a clear view that the number of pending cases has become so excessive, resulting in newlinehuge trouble for our judicial or quasi-judicial institutions to provide efficient and speedy newlineJustice to litigants of our nation. This is currently a severe problem in our country. Hence, newlinesome development is seriously needed in the procedural laws and judicial system to speed newlineup adjudication of the pending or upcoming litigations. My thesis will provide suggestions newlineto resolve the above-mentioned problems based on research and comparison of government newlinerecords, data, reports, foreign law, government RTI replies, our old and newly enacted newlineprocedural laws, etc.quot newline newline
